1. What Duavia is
Duavia is a marketplace connecting learner drivers with independent driving instructors and driving schools in Switzerland. The teaching contract is between the learner and the instructor or school. Duavia is not a driving school and does not provide instruction.
2. Who may book
You may open an account and book at any age at which you may lawfully hold a Swiss learner permit. Many learners are therefore minors, and that is expected.
A booking is a paid contract. Under Art. 19 of the Civil Code a person under 18 needs the consent of a parent or legal guardian to enter into one, so we ask for your date of birth when you register and, if you are under 18, for the name and e-mail address of a parent or guardian, whom we notify. Booking while under 18 is a confirmation that you have their agreement.
3. Payment and the platform fee
Duavia is the merchant of record. The learner pays Duavia at the time of booking, and Duavia holds the funds until they are released to the instructor as described in section 4.
A platform fee is charged once per checkout, not per lesson. It is banded by the size of the basket, and is shown in full before payment is confirmed. There are no fees added later in the process.
There is a maximum for a single checkout, and the exact amount is shown to you at the checkout before you pay. A larger basket must be split into separate bookings.
4. When the instructor is paid
Funds are released to the instructor only after the cancellation window for the booking has closed. For a standard booking, that is the lesson start time minus the instructor’s cancellation window. Bookings sold as non-refundable are released on payment. A package is released in full once the cancellation window of its first scheduled lesson closes, or 30 days after purchase if no lesson has been scheduled by then.
5. Cancellation and refunds
If the learner cancels inside the cancellation window the lesson price is refunded in full. The platform fee is not refunded: it paid for the transaction, and the transaction took place.
If the learner cancels after the window has closed or does not attend, no refund is due. Nothing is refunded on a booking sold as non-refundable, whenever the learner cancels.
If the instructor or Duavia cancels the learner is refunded 100 %, including the platform fee, regardless of the cancellation policy on the booking and regardless of when the cancellation happens. A booking sold as non-refundable binds the learner, not the instructor.
6. Instructor obligations
Instructors confirm on registration that they hold a valid Swiss teaching authorisation and valid liability insurance. An instructor who teaches a car category (B or BE) additionally confirms that they have a suitable dual-control vehicle; no vehicle declaration is taken from an instructor who teaches motorcycle categories only, because there is no dual-control motorcycle. Duavia verifies these by self-declaration with spot checks; a verified badge is shown only after review.

7. Your data
What we collect about you, who else receives it (including your instructor, who is a separate controller for it), how long we keep it and how you obtain a copy or have it deleted are all set out in the privacy policy, which forms part of these terms. Privacy
8. Governing law and jurisdiction
These terms are governed by Swiss law, to the exclusion of its conflict-of-law rules and of the Vienna Sales Convention.
The ordinary place of jurisdiction is the registered seat of the company named in the legal notice. If you are a consumer, that clause does not take anything away from you: the Code of Civil Procedure gives you the choice of the court at your own domicile or at ours, and you cannot validly give up that choice in advance of a dispute. Nothing here purports to do so.
